NEW DELHI: On Monday, Uttarakhand achieved a historic milestone by becoming the first state in India to implement the Uniform Civil Code (UCC). Chief Minister Pushkar Singh Dhami officially launched the UCC portal and issued a notification, marking the beginning of a new era for the state.
Speaking at the launch, Dhami emphasized that the Uniform Civil Code is a constitutional step aimed at eliminating discrimination and ensuring equal rights for all citizens. “This measure will play a significant role in empowering women in the truest sense. Practices like halala, polygamy, child marriage, and triple talaq can be eradicated entirely with the implementation of the UCC. Additionally, we have excluded Scheduled Tribes recognized under Article 342 of the Constitution to safeguard their unique traditions and rights,” Dhami said.
He further clarified, “The Uniform Civil Code does not target any religion or sect. It is not against anyone but is a step towards ensuring equality for all. The credit for this monumental step goes to the people of Devbhoomi Uttarakhand, who placed their trust in us. By implementing the UCC, we are paying homage to the vision of Babasaheb Bhimrao Ambedkar and the members of the Constituent Assembly. From this moment onward, all citizens of Uttarakhand have equal constitutional and civil rights, and women from all religions enjoy equal status.”
What Is Uniform Civil Code?
The UCC is a comprehensive set of laws designed to standardize personal laws across religions. It covers various aspects like marriage, divorce, inheritance, and live-in relationships, ensuring equal property rights and safeguarding children’s rights. Non-compliance with these laws will attract penalties.
Key Features of Uttarakhand’s UCC
- Marriage: The UCC specifies that only mentally capable individuals aged 21 (for men) and 18 (for women), who are not already married, can legally marry. While marriages can still be conducted according to religious customs, registration will now be mandatory for legal recognition.
- Testamentary Succession: The law also governs the creation and revocation of wills and codicils.
- Registration of Marriages: Marriages solemnized before March 26, 2010, or those conducted outside Uttarakhand, will also be eligible for registration, provided they meet legal criteria.
With this bold step, Uttarakhand has set an example for the nation, paving the way for equality and legal uniformity in personal matters.
