Allahabad High Court grants interim relief to Asaduddin Owaisi

The Allahabad High Court has granted interim relief to AIMIM MP Asaduddin Owaisi in the case of criticism of the Ram Janmabhoomi verdict.

The court directed that no coercive action be taken against Owaisi till April 24 and sought a reply from the government within two weeks.

A single bench of Justice Rajiv Gupta passed the order while hearing an application filed by Asaduddin Owaisi under Section 482.

The counsel for the applicant has submitted that the applicant is being tried for an offence under Section 153(A) of the IPC, however, necessary sanctions have not been taken from the concerned authority as required under Section 196(1) CrPC and as such, the entire proceedings are bad in the eyes of law.

The court said that this matter needs to be considered.

The court has given two weeks time to the respondents to file counter affidavits.

“Till then, complaint cases (MPs/MPs) No coercive action will be taken against the applicant under Sections 153-A, 295-A, 298 IPC, Police in No. 566 2022 (Rakesh Pratap Singh vs Asaduddin Owaisi and others). Station Shohratgarh, Pending in the court of District Siddharth Nagar, Chief Judicial Magistrate, Siddharth Nagar”, the court ordered.

The court listed the matter for further hearing on April 24, 2023.
